These Terms of Use (“Terms”) govern your access to and use of the Nahnu Asset Scanner plugin, the website located at frontendassetscanner.com (“Site”), and any related services, documentation, or content (collectively, the “Service”) provided by Nahnu Fitness LLC, operating under the brand name Nahnu Plugins (“we,” “us,” or “our”).

By downloading, installing, activating, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. About the Service

Nahnu Asset Scanner is a free WordPress plugin that scans the front end of a WordPress website and produces an inventory of JavaScript files, CSS stylesheets, cookies, and third-party domains detected during a page load. The Service is intended to assist WordPress site owners, developers, and agencies in understanding what is loaded on their sites for purposes including cache optimization, cookie consent configuration, and privacy compliance research.

The Service does not provide legal, compliance, or privacy advice. Any use of scan results for regulatory or legal purposes is solely your responsibility.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal authority to agree to these Terms on behalf of yourself or any organization you represent.

3. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Service solely for your own lawful purposes on websites you own or are authorized to manage.

The plugin is distributed under the GNU General Public License v2.0 or later (GPL-2.0+). Nothing in these Terms limits, supersedes, or conflicts with the rights and obligations set forth in the GPL. Where these Terms and the GPL conflict, the GPL controls with respect to the software license.

4. Permitted Use

You may use the Service to:

Scan websites you own or have explicit authorization to scan.
Review and export scan results for your own internal purposes.
Share scan results with clients, colleagues, or third parties in connection with services you provide.
Modify the plugin code in accordance with the GPL.

5. Prohibited Use

You may not use the Service to:

Scan websites you do not own and do not have explicit authorization to scan.
Attempt to reverse-engineer, decompile, or extract proprietary components of the Service beyond what the GPL expressly permits.
Use the Service in any manner that violates applicable local, state, national, or international law or regulation.
Use the Service to collect, harvest, or process personal data of third parties without appropriate legal basis under applicable privacy law.
Misrepresent the source, output, or findings of the Service.
Redistribute the plugin under a different name or brand without clearly disclosing the original source in accordance with the GPL.
Use the Service in any way that could damage, disable, overburden, or impair our infrastructure or the websites of others.

6. Third-Party Data and Databases

The Service may optionally fetch third-party data files, including the Open Cookie Database (MIT License) and the Ghostery TrackerDB (CC-BY-NC-SA 4.0), directly from their respective GitHub repositories. These databases are maintained by independent third parties. We do not control, endorse, or guarantee the accuracy, completeness, or availability of these databases.

Your use of third-party database content is subject to the applicable licenses of those databases. We are not responsible for any changes, removal, or inaccuracies in third-party data.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NAHNU FITNESS LLC AND THE NAHNU PLUGINS BRAND EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;
WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF SCAN RESULTS;
WARRANTIES THAT THE SERVICE IS SUITABLE FOR ANY REGULATORY, LEGAL, OR COMPLIANCE PURPOSE.

SCAN RESULTS ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY. THEY DO NOT CONSTITUTE LEGAL ADVICE, COMPLIANCE CERTIFICATION, OR A GUARANTEE THAT YOUR SITE MEETS ANY REGULATORY REQUIREMENT. YOU ARE SOLELY RESPONSIBLE FOR HOW YOU INTERPRET AND ACT ON SCAN RESULTS.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NAHNU FITNESS LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES;
COSTS OF PROCURING SUBSTITUTE SERVICES;
DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR WEBSITE OR DATA;
DAMAGES ARISING FROM YOUR RELIANCE ON SCAN RESULTS FOR COMPLIANCE, LEGAL, OR OPERATIONAL DECISIONS.

THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

BECAUSE THE SERVICE IS PROVIDED FREE OF CHARGE, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED FIFTY US DOLLARS ($50.00).

9. Indemnification

You agree to indemnify, defend, and hold harmless Nahnu Fitness LLC, its members, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

Your use of or inability to use the Service;
Your violation of these Terms;
Your violation of any applicable law or regulation;
Your scanning of websites you are not authorized to scan;
Any claim that your use of the Service infringes the rights of a third party.

10. Intellectual Property

The Nahnu Asset Scanner name, Nahnu Plugins brand, and associated logos and trade dress are trademarks of Nahnu Fitness LLC. Nothing in these Terms grants you any right to use our trademarks without our prior written permission.

The plugin source code is distributed under the GPL-2.0+ license. All other content on the Site, including text, graphics, and design, is owned by Nahnu Fitness LLC and may not be reproduced without permission.

11. Privacy

Our collection and use of information in connection with the Service is described in our Privacy Policy, available at frontendassetscanner.com/privacy-policy/. The plugin itself does not collect, transmit, or store any data outside of your own WordPress database. The only outbound network requests the plugin makes are the optional one-click database fetches from GitHub described in Section 6, which you initiate manually.

12. Support

Support for the Service is provided on a best-effort basis by the Nahnu Plugins team. We have no obligation to provide support, updates, bug fixes, or new features. We may discontinue, modify, or deprecate the Service at any time without notice or liability.

13. Modifications to the Terms

We reserve the right to modify these Terms at any time. When we do, we will update the “Last updated” date at the top of this page. Your continued use of the Service after any modification constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

14. Termination

We may suspend or terminate your access to the Service at any time, for any reason or no reason, with or without notice, including if we believe you have violated these Terms. Upon termination, the license granted in Section 3 ends immediately, though the GPL rights to the software code remain. Sections 7, 8, 9, 10, 14, 15, and 16 survive termination.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Washington, USA, without regard to its conflict of law principles.

Any dispute arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Washington State, and you consent to the personal jurisdiction of those courts.

BOTH PARTIES WAIVE THE RIGHT TO A JURY TRIAL AND AGREE THAT ANY DISPUTE WILL BE RESOLVED ON AN INDIVIDUAL BASIS. CLASS ACTIONS AND CLASS ARBITRATIONS ARE NOT PERMITTED.

16. General Provisions

Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Nahnu Fitness LLC regarding the Service and supersede all prior agreements and understandings.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

No Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

No Agency. Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and us.

Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.

Notices. Any notices to us under these Terms should be sent to the contact information provided on the Site.
